Many disputes can be resolved without the need for filing of suit if an effective and meaningful dialog can be established between parties.  In many instances, parties are more inclined to settle disputes outside of court when they are shown "the errors of their ways" and also when they are faced with the prospect of legal fees to defend a court action in which they are "likely to lose".
