What is it?

"Eminent domain" (commonly referred to as 'condemnation') is a power granted to government bodies (municipalities, state and federal agencies) under federal and state constitutions to acquire property for public use through court action.  The acquiring body must pay to the owner of such property "Just Compensation" for the property at the time of the taking.  Generally Speaking, just compensation is an amount equal to the value of the property at the time of the taking at the property's highest and best use.

It is important to take certain steps while under the threat of condemnation, as well as actions that should be taken once formal proceedings have been initiated so as to preserve your rights regarding this matter.
